			<content:encoded><![CDATA[<p>TRI-CITIES, Wash. &#8212; A backhoe operator was fatally injured in a construction accident at a Bonneville Power Administration substation on the Hanford nuclear reservation.</p>
<p>BPA spokesman Doug Johnson says Kelly Loyd of Castle Rock was doing some excavation work Monday at the White Bluffs substation when he was injured. He was taken to Kadlec Medical Center in Richland where he died. Loyd was employed by Christenson Electric Inc.</p>
<p>The Tri-City Herald says the federal Occupational Safety and Health Administration and the state Department of Labor and Industries are deciding which agency would investigate.</p>

			<content:encoded><![CDATA[<p>Prosecutors have charged a caretaker who claims he accidentally raped an elderly resident at the nursing home where he works.</p>
<p>Douglas McGregor, 35, has been charged with second-degree rape in an incident that occurred at the Weatherly Inn at Lake Meridian, an assisted living facility for Alzheimer&#8217;s patients.</p>
<p>The alleged rape took place last week when an employee heard the 71-year-old woman crying in her room, according to Kent police. The employee opened the door and found McGregor standing over the woman with his genitals exposed.</p>
<p>&#8220;She was a vulnerable adult and she was in no position to give consent for any type of sexual activity,&#8221; said Lt. Lisa Price. &#8220;This is a heinous crime. This is despicable.&#8221;</p>
<p>When questioned by detectives, McGregor claimed his sexual contact with the victim was accidental after she broke the button on his pants, exposing him.</p>
<p>However, the incident has left the woman devastated, according to her son.</p>
<p>&#8220;I find it very upsetting,&#8221; said the man. &#8220;The Weatherly Inn has been a very good place. We&#8217;ve been very happy there for three and a half years. It has a good reputation, and that&#8217;s why she was put there. You feel betrayal.&#8221;</p>
<p>Police say the home&#8217;s administrators called 911 and alerted the residents&#8217; relatives immediately after learning about the alleged attack.</p>
<p>&#8220;It is not anything we ever expected at the Weatherly Inn. We&#8217;ve never had anything like that happen,&#8221; said Kristi Knox, general manager of the facility.</p>
<p>McGregor has been booked into the King County Jail and is being held on $250,000 bail. He has no prior criminal history.</p>

<p>Richard Hess, 63, died at the scene about 4 p.m.</p>
<p>Hess was eastbound in a Nissan Titan when he left the road to the left, overcorrected, crossed both eastbound lanes and rolled, troopers said. The pickup landed on its wheels on the right shoulder.</p>
<p>The cause of the crash remained under investigation, but authorities said Hess was incorrectly wearing his seat belt.</p>
<p>Investigators said they did not know whether intoxicants were involved.</p>

			<content:encoded><![CDATA[<p>A Palo Alto woman who tripped on a raised sidewalk has been awarded $24,000 by an outside arbitrator.</p>
<p>Paula Goldberg, 59, tripped over a buckling slab of concrete at 419 Waverley St. in June 2006, tearing a ligament in her thumb as she attempted to break her fall, according to Michael Servarian, the city&#8217;s hired attorney.</p>
<p>Goldberg filed suit in Santa Clara County Superior Court in June 2007 and both sides entered into mandatory nonbinding arbitration in July 2009, Servarian said.</p>
<p>&#8220;Both sides accepted the award. It is very unusual for both sides to accept a settlement,&#8221; he said, pointing out that if one side is happy and the other is not, the dissatisfied party can still choose to go to trial. Both sides seemed content with the award, he said.</p>
<p>The sidewalk was most probably repaired after the accident, Servarian said.</p>
<p>&#8220;What often happens is a person falls and submits a claim then Public Works fixes it,&#8221; he said.</p>
<p>Mike Sartor, assistant director of Public Works, said he did not know when the sidewalk was repaired. He referred comment to the attorney.</p>
<p>Greg Cattermole, attorney for Goldberg, was in court on Tuesday and did not return phone calls requesting comment.</p>

<p>The Washington State Patrol says it has made 713 arrests for DUI in King County since Thanksgiving week, including 256 from holiday emphasis patrols. Some arrests are still being counted.</p>
<p>The good news is that there were no alcohol-related traffic deaths.</p>
<p>The emphasis patrols &#8212; seven troopers and one sergeant who patrolled the county at night &#8212; worked with several other police agencies as part of what was called the X-52 DUI patrols.</p>
<p>The patrol counted one alcohol-related accident with serious injuries. The patrol said that occurred Dec. 15 when a repeat DUI offender crossed the center median on eastbound Interstate 90 at Preston and hit a westbound motorist head on. Both drivers remain in the hospital.</p>
<p>We however, do not have the statistics for how many of these drunk drivers caused personal injuries to the innocent. 			<content:encoded><![CDATA[<p>About 447,000 Dorel baby car seat carriers are being recalled after dozens of reports of the child restraint handle coming loose.</p>
<p>There have been at least three injuries to babies, including bumps, bruises and a head injury. Dorel Juvenile Group Inc., of Columbus, Ind., has received 77 reports of the child restraint handle fully or partially coming off the products.</p>
<p>The recall involves Safety 1st, Cosco, Eddie Bauer and Disney branded infant car seat carriers with certain model numbers. They were sold at department and juvenile product stores nationwide from January 2008 through this month.</p>
<p>The recall was announced on Friday by the Consumer Product Safety Commission, National Highway Traffic Safety Administration and Dorel Juvenile Group.</p>
