Medical Malpractice FAQs From Kent Injury Attorneys
March 3, 2011 by admin · Leave a Comment
Q. My doctor released my medical records to my employer. Can I sue?
A. It depends. Most medical records are confidential under HIPPA. Consulting a medical malpractice attorney can help you determine whether you have to disclose your records and whether or not you have a case.
Q. I was misdiagnosed. Do I have a malpractice case?
A. If your doctor exercised his judgment but his/her care did not fall below the standard of care, you may not have a case. The law does not require doctors to be perfect, only to follow standard procedures in seeking to diagnose and treat illness or injuries.
Q. What are these “standards of care” and who determines what they are?
A. The medical community provides the measuring stick as to what is the standard of care. This measuring stick is not as exact as a tape measure. It takes into account many variables. But the ultimate goal is to determine whether a physician or other health care professional acted in a manner consistent with or below the standard practices of other like professionals. This why the testimony of expert witnesses who have experience in the same practice area are essential for winning a medical malpractice suit.

Q. Why is brain injury a separate specialty from other injuries?
September 15, 2010 by admin · Leave a Comment
A. Traumatic brain injuries are a personal injury specialty because they can occur under many different circumstances—automobile accident, sports accident, medical negligence, construction site accident, maritime accident, etc. For this reason, many legal firms have attorneys that are especially skilled in working with brain injury cases.
If you or a family member have suffered brain injuries of any kind due to the negligence of another a personal injury settlement may be a possibility. Contact a Washington brain injury lawyer at our firm today to learn more.

Choosing the Right Personal Injury Lawyer

Choose the right attorney carefully. Be sure the attorney you hire practices only personal injury law. My practice is devoted to helping injured people. My firm only handles personal injury law cases for injured persons or victims of other torts.
Injured in Kent? Contact our Kent, WA personal injury attorneys for a free case evaluation at a place of your convenience.
My advice is to choose an attorney with whom you are comfortable and trust, one who is sensitive, caring and dedicated to helping injured people, and one who will aggressively represent you. It is unlikely that you will find any other attorney who has been through what I have been after my accident in July of 1985. Hire an attorney who has a track record of going to trial, not just settling cases, as insurance companies will settle for more compensation if your counsel has a track record of going to trial. Please email us at rob@kornfeldlaw.com or call 1 (800) 282-4878. We will gladly send you an informational brochure featuring our firm’s successes at no charge.

What You Are Entitled to After Being Injured in a WA Car Accident
June 22, 2010 by admin · Leave a Comment
In all personal injury cases, including motor vehicle accident cases of all types, you are entitled to recover general damages for your pain and suffering, emotional distress, disability, permanent disfigurement, scarring, loss of opportunity to enjoy life, interference with the husband/wife or parent/child relationship, wrongful death, loss of services, dismemberment and any other type of general damage relating to injury. You are also entitled to recover special damages, including are past, present and future medical bills, wage loss, loss of earnings potential and other out-of-pocket expenses. It is your attorney’s obligation to properly prepare your case and determine what these damages are. This usually takes place after your medical condition is stabilized.
At the point when your medical condition stabilizes, which means you will not get any better or worse, your attorney should speak to your doctors and obtain medical reports regarding your prognosis. At the conclusion of your recovery, the attorney shall put together a settlement demand package to try and resolve your case with the insurance company. From that point forward, negotiations will take place. Your attorney should be goal oriented to maximize your RECOVERY.
If your case does not settle, your attorney will file suit and proceed to trial. Many times an insurance company will not pay you what you deserve to recover until your case is set for trial or close to trial. Insurance companies know which attorneys take cases to trial and which attorneys settle cases. The attorneys who proceed and prepare a case as though it shall proceed to trial will likely recover more money for you than a settlement lawyer. It behooves all attorneys to try and settle cases. However, if cases do not settle in a reasonable period of time, it behooves everyone to file suit and prosecute your case, preparing for trial.
This is the best way to financially maximize your RECOVERY.

FAQ: If I am involved in a pedestrian accident, what should I do?
June 7, 2010 by admin · Leave a Comment
Q. If I am involved in a pedestrian accident, what should I do?
A. Don’t leave the scene of the accident unless it is in an ambulance. If you are able to do so, get the information of the person involved in the accident—name, address, phone number, drivers license number and expiration date, vehicle license plate, registration and insurance company and policy number. Also get the contact information of anyone who witnessed the incident (this includes passengers in the vehicle). Call the police and wait for them to arrive. If they don’t come to the scene, file a report immediately. You will want to contact your insurance company and make them aware of the accident. It is important to remember that even if you are the victim of a hit-and-run, you need to report the incident to the police and to your insurance company.
