Mr. Kornfeld has handled many cases in which workers elect to bring a third party claims against a negligent contractor for failing to enforce WISHA or OSHA safety regulations. The worker does not give up his or her rights to recover worker’s compensation benefits (for wage loss, medical expenses, vocational retraining, and whatever other benefits which are first party L & I rights) by filing a third party claim. It is recommended that you hire an attorney to represent you with your third party claim against a negligent contractor.
