RCW 4.20.020 entitles all beneficiaries to join in a wrongful death claim on behalf of the estate of the deceased. The action shall be for the benefit of a wife, husband, child or children, including step-children of persons who death shall have been so caused. If there is not a wife, husband or child, a wrongful death action may still be maintained for the benefit of parents, sisters or brothers, providing each are dependent upon the deceased person for support and who are residents within the United States at the time of the death.
Over the years, we have had many inquiries regarding bringing a wrongful death claim for the loss of an adult child. Washington statute requires that a parent can only recover for the death of an adult child, one 18 years of age or older, if they are “dependent” on the deceased child for support. “Dependent upon” for support means that either through financial means or other labor efforts, the surviving sibling or parent is being supported in some way by the deceased child or sibling. In such a situation, a wrongful death case may be maintained.

Construction worker killed in Hanford accident

TRI-CITIES, Wash. — A backhoe operator was fatally injured in a construction accident at a Bonneville Power Administration substation on the Hanford nuclear reservation.
BPA spokesman Doug Johnson says Kelly Loyd of Castle Rock was doing some excavation work Monday at the White Bluffs substation when he was injured. He was taken to Kadlec Medical Center in Richland where he died. Loyd was employed by Christenson Electric Inc.
The Tri-City Herald says the federal Occupational Safety and Health Administration and the state Department of Labor and Industries are deciding which agency would investigate.

Rollover crash kills Chelan man near Cle Elum

A Chelan, Wash., man was killed after rolling his pickup on Interstate 90 just west of the Cle Elum exit on Monday, the Washington State Patrol reported.
Richard Hess, 63, died at the scene about 4 p.m.
Hess was eastbound in a Nissan Titan when he left the road to the left, overcorrected, crossed both eastbound lanes and rolled, troopers said. The pickup landed on its wheels on the right shoulder.
The cause of the crash remained under investigation, but authorities said Hess was incorrectly wearing his seat belt.
Investigators said they did not know whether intoxicants were involved.

Man from Concrete killed on Hwy. 20

A Concrete man was killed and a friend of his was injured early Saturday on Highway 20, about three miles west of town, when the vehicle they were in struck a utility pole and both men were ejected.
State Patrol troopers said the man who died in the crash, 25-year-old Christopher Paul Lilly, wasn’t wearing a seat belt and may have been driving under the influence. The crash occurred near the intersection of the highway and Challenger Road and was reported about 4:35 a.m. Saturday.
Lilly was driving a 2002 Chrysler PT Cruiser east on the highway when he lost control, troopers said.
His passenger — Brice D. Kucera, 21, of Concrete — told investigators that the two men had been in Bellingham drinking and were returning home, said Trooper Keith Leary, a Patrol spokesman.
Both men were ejected in the accident and Kucera was knocked unconscious, Leary said.

2007 Seattle Wrongful Death Lawsuit Settled

The family of a 19-year-old man, whose death on a Seattle street in 2007 triggered a community outpouring for better bike-safety measures, has settled a lawsuit against the company that owned the dump truck that crushed him.
The parents of Bryce Lewis, Marc and Laura Paolicelli of Colorado, have agreed to an undisclosed sum of money from Nelson & Sons Construction of Woodinville, said the family’s attorney, John Christensen of Tacoma.
“Nelson & Sons stepped forward and did the right thing and the family was satisfied by their gestures,” Christensen said Tuesday.
The Seattle Wrongful Death Attorney for Nelson & Sons could not be reached for comment.
